How to cancel AGCOM sanctions
The Italian technology website, Giardiniblog.it, saw the lifting of a blocking order issued by the telecommunications authority AGCOM. The site, which receives about 1 million monthly visits, had previously been blocked by Italian ISPs for posting information on how to bypass anti-piracy blocks.
After a legal challenge to a regional court, AGCOM overturned its own blocking order, restoring accessibility to Giardiniblog.it. However, the reasons behind this original blocking raise concerns about the scope of website blocking in Italy.
The newspaper, which also publishes articles in the paper magazine Win Magazine, had appealed to the Regional Administrative Court of Lazio, through the Sarzana Law Firm in Rome, complaining about the illegitimacy of the Authority's provision and asking the Lazio Regional Administrative Court to suspend AGCOM's provision.
In view of the precautionary hearing of 15 May 2024 before the Administrative Judge, the President of the Communications Guarantee Authority has ordered the ex officio annulment of his own inhibition order, asking the Court to conclude the matter and sending the Italian providers the reinstatement order.
It was therefore a revocation of the self-protection measure issued by the administrative authority which, evidently, at the urging of the Rome lawyers of the law firm, reversed its decision.
The TAR of Lazio, having acknowledged the annulment of the AGCOM inhibition order, has ordered the cancellation of the case from the register
