On 9 December 2021, the implementing decree of Directive 2018/1972 establishing the European Electronic Communications Code. The text, which came into force 15 days later, introduces new protections for consumers and aims to improve the quality of services. Here's what it envisions and what will change for users.
The Code first of all requires operators to insert at least one offer with a maximum initial duration of 12 months and fixed to 24 months The maximum duration of a telephone contract. Currently, some last up to double that (48 months) and require the consumer to continue paying even after termination.
This change will also apply to non-consumer users, such as micro businesses, professionals and organizations.
One aspect that the jurist Fulvio Sarzana, in an interview with Il Sole 24 Ore a few weeks ago, defined it as an “important innovation” given that “previously it was only foreseen in some resolutions of the Agcom” and “now it becomes primary norm”.
