The Regional Administrative Court (TAR) suspends the AGCOM fine on online tickets.

The Regional Administrative Court of Lazio, Rome office, suspended as a precautionary measure, in mid-April, the fine of 4 million that had been imposed by the Communications Regulatory Authority (AGCOM) on an operator accused of having carried out a conduct of secondary ticketing.

the term secondary ticketing This refers to the resale of tickets for entertainment activities, tickets that have been purchased from authorised primary channels (physical sales points/box offices, organizers' websites, primary resale websites).

Law 11 December 2016, n. 232, containing “State budget forecast for the 2017 financial year and multi-year budget for the three-year period 2017-2019” introduced, in art. 1, paragraph 545, a new type of administrative offence consisting in the “sale or any other form of placement of tickets for access to entertainment activities carried out by a person other than the holders, even on the basis of a specific contract or agreement, of the systems for their issuance“. Only the following is saved “the sale at a price equal to or lower than the nominal price of tickets for entertainment activities carried out by a natural person on an occasional basis, provided that it is not for commercial purposes“.
