It has been established and is therefore operational
The Code of Conduct was promoted by AssoSoftware, the Association representing software production companies, after an intense study and development activity carried out in collaboration with the offices of the Garante per la protezione dei dati personali.
At the board meeting of October 17, 2024, the Authority approved the Code of Conduct and accredited the related Monitoring Body, effectively making the Code operational for all Italian software producers.
The ODM is made up of individuals with extensive experience in software production and management and also integrates specific skills in the personal data protection sector.
Among its members is the lawyer Fulvio Sarzana, of the Studio legale Sarzana e Associati.
On 27 November 2024, the Code of Conduct is published in the Official Journal, in its final version, which provides for the establishment of the Undersigned Organismo di Monitoraggio (hereinafter “OdM”) responsible for verifying compliance with the aforementioned Code.
L’OdM viene accreditato dal Garante per la Protezione dei Dati Personali in data 17 ottobre 2024.
Has the task of monitor compliance with the Code by companies adhering to it e di manage any complaints da parte degli interessati.
The OdM's duties include settling disputes between data subjects and companies that own personal data, through the adoption, where necessary, of measures, including sanctions, as set out in the OdM's Code of Conduct and Internal Regulations.
