Europe attacks platforms with DSA

Interview with jurist Fulvio Sarzana, on Repubblica.it, on the new rules of the Digital Services Act (DSA).

The EU Commission is beginning to exercise the powers established by the digital services packages.

In particular, on 13 June, the Commission announced an action aimed at verifying the protection of minors on computer networks.

This EU action falls within the European Digital Services Act (DSA) and
This follows the Commission's decision in December to include several sites in the new rules.

From subjects subject to the rules to actual suspects, under scrutiny by European authorities: this is the step marked by the European Commission's announcement on June 13.
An action which among other things puts the spotlight on a major unresolved issue: how
identify the age of digital users.
“The age verification system now seems inevitable in the digital context,
at least in Europe and in Italy", he comments Fulvio Sarzana, among the first and best known
digital law lawyers. And Italy itself "has taken a leading role in
this field, with provisions and regulations that anticipate and specify the
rules of the Digital Services Act,” he adds.

Age verification
In Italy, "the identification of the age of minors starts both from what is established and from the
decree-law converted on 13 November 2023 “Urgent measures to combat the
youth hardship, educational poverty and juvenile crime, as well as for the
safety of minors in the digital sphere", which however has not yet received
today the detailed regulation necessary for its complete
activation as foreseen by the DSA,” explains Sarzana. Italy is not alone.

“There is however a problem of competences in light of the DSA, because the supervision
on large platforms it is the responsibility of the EU Commission directly, while the
control over all other platforms is the responsibility of the national supervisory authorities,
which in Italy is Agcom”, notes Sarzana.

Hopefully we won't see the same problem that arose on the continent with the GDPR.
