The news site Giardiniblog, managed by an Italian company, had been blocked from access by Italian providers, by virtue of a provision of the Communications Regulatory Authority (AGCOM), published on April 4, 2024, for alleged copyright violations. Giardiniblog, gestita da una società italiana, era stata inibita all’accesso da parte dei provider italiani, in virtù di un provvedimento dell’Autorità per le garanzie nelle comunicazioni ( AGCOM), pubblicato il 4 aprile del 2024,  per presunte violazioni del diritto d’autore.

La testata, che pubblica articoli anche sulla rivista cartacea Win Magazine, aveva fatto ricorso al Tribunale Amministrativo Regionale del Lazio, attraverso lo Studio Legale Sarzana di Roma,  lamentando l’illegittimità del provvedimento dell’Autorità e chiedendo al Tar del Lazio la sospensione del provvedimento dell’AGCOM.

In view of the precautionary hearing of 15 May 2024 before the Administrative Judge, the President of the Communications Guarantee Authority has ordered the ex officio annulment of his own inhibition order, asking the Court to conclude the matter and sending the Italian providers the reinstatement order.

The TAR of Lazio, having acknowledged the annulment of the AGCOM inhibition order, has ordered the cancellation of the case from the register
