Privacy sanctions: how to defend yourself
Have you received a fine from the Italian Data Protection Authority and need to defend yourself? Has someone reported you for violating your personal data processing? Have you received an administrative notification regarding privacy? Have you received a fine regarding privacy and need to defend yourself? Do you need to write a privacy policy for your company?
The third session of Iothings Rome 2018 in which the Sarzana Law Firm participated, following the one on the Internet of Things and the one on blockchain, is dedicated to the General Data Protection Regulation (GDPR) and the sanctions provided for by the EU law and the legislative decree implementing it.
The Sarzana Law Firm He explained how to defend against privacy sanctions and illustrated the most effective defense techniques in the event of inspections.
In particular, Fulvio Sarzana, on November 22nd at 3:30 pm, addressed the issue of sanctions and the behavior and solutions to adopt in the event of inspections.
Sarzana was interviewed about the matter: "Before the GDPR, in Italy, companies could know in advance the minimum or maximum amount of a fine, based on the type of violation detected by the Guardia di Finanza. The GDPR, however, only establishes the maximum amount. Companies can only know the actual amount after the Guarantor has issued the fine," Sarzana continues.
The problem now is that the Authority's stalemate is also delaying the creation of a "case law" regarding GDPR sanctions; in the absence of this history, in short, "it's not yet possible to understand Italy's stance on their extent," says Sarzana.
“"This very strict regime, without providing significant case studies on the criteria for applying sanctions (even though they are abstractly provided for by the regulations), makes it difficult to assess the true impact of the sanctions provided for by the GDPR, and also raises the real risk of the regulations themselves being disapplied," explains Sarzana.
