In Italy, the first real legislation against cyber crime was the Law 547 of 1993 (“Amendments and additions to the provisions of the Criminal Code and the Code of Criminal Procedure relating to cybercrime”), which amended and added to the provisions of the Criminal Code and the Code of Criminal Procedure relating to cybercrime.

What are computer crimes?

We can divide the computer crimes regulated by our law into four macro-categories:

– the computer fraud, provided for by article 640 ter of the penal code which consists in altering a computer system for the purpose of obtaining an unfair profit;
– unauthorized access to a computer or telematic system (615 ter of the Criminal Code);
– the illegal possession and distribution of access codes to computer and telematic systems (615 quater of the penal code);
– the dissemination of computer equipment, devices or programs aimed at damaging or interrupting a computer or telematic system (615 quinquies of the Criminal Code)
