The Court of Cassation held that theThe Entity is also liable, pursuant to Legislative Decree 231/2001, when the natural person of the employee charged with the underlying crime has been acquitted for not having committed the crime.
In particular the perpetrator of the underlying crime – an employee of the company – had been acquitted of the crime of stock manipulation.
