The Council of State rejected the appeal on the Free Modem issue and granted new powers to AGCOM. The announcement was made by Fulvio Sarzana, a lawyer for Assoprovider, which had joined the lawsuit along with various associations to defend the Authority's resolution.
“The sixth section of the Council of State issued a ruling on 2 August 2021, declaring partly inadmissible and partly unfounded the appeal presented by Telecom Italia against the Agcom resolution on free modems.”, explained the lawyer, who echoes Gabriele Fiorentino of the Free Modem Alliance Association who highlighted that "“Three years have passed since the adoption of Resolution 348/18/CONS, with which AGCOM, in compliance with the European regulation
