Drafts of the legislative decree introducing provisions for adapting national legislation to the provisions of the European Regulation on the protection of natural persons with regard to the processing of personal data and on the free movement of such data are beginning to circulate.
The draft legislative decree was preliminarily approved by the Council of Ministers on 21 March 2018.
The Prime Minister's press office, shortly before the government's resignation, had released the following statement:
PRIVACY CODE
Provisions for the adaptation of national legislation to the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (legislative decree – preliminary examination)
The Council of Ministers, upon a proposal from President Paolo Gentiloni and Minister of Justice Andrea Orlando, has approved, in preliminary examination, a legislative decree that, implementing Article 13 of the European Delegation Law 2016-2017 (Law No. 163 of 25 October 2017), introduces provisions to adapt national legislation to the provisions of the European Regulation on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
From 25 May 2018, the date on which the provisions of European law will become effective, the current Code on the protection of personal data, pursuant to Legislative Decree no. 196 of 30 June 2003, will be repealed and the new legislation on the matter will be represented mainly by the provisions of the aforementioned Regulation which are immediately applicable and by those contained in the draft decree aimed at harmonising the internal legal system with the new regulatory framework of the European Union on the protection of personal data. privacy.
The INTERLEX magazine, directed by the long-time journalist Manlio Cammarata, who deserves our compliments for the scoop, has published first the draft legislative decree.
It is obviously not known whether this draft constitutes the final text, whether it is a version prior to its preliminary submission to the Council of Ministers, where it was approved with reservations, or whether the text is a subsequent reworking.
