Regarding serious evidence of guilt for the purposes of surrender to a foreign country, Supreme Court case law has repeatedly clarified that "in matters of surrender abroad, in order to establish the prerequisite of serious evidence of guilt pursuant to Article 17, paragraph 4, of Law No. 69 of 22 April 2009, the issuing State must specify the sources of evidence in the warrant, by specifically attaching the factual evidence against the person whose surrender is requested. It follows that mere duplication of the narrative of the indictment does not allow for surrender."«
